SECTION 1 — ACCEPTANCE OF THE TERMS

By accessing, installing, browsing or using any applications or services provided by Web Evolui (‘Applications’ and ‘Services’), you declare that you have read, understood and agree to these Terms of Use (‘Terms’). If you do not agree, do not use the Applications or Services.

SECTION 2 — SCOPE

Web Evolui develops applications and maintains a website for various purposes. Some Applications may work without collecting personal information and, in certain cases, without internet access. Others may require internet access or request data for specific functions, such as purchases, delivery, support, premium access or similar features. These Terms apply to all Applications and Services where applicable.

SECTION 3 — PRIVACY

The processing of personal data, where it takes place, is governed by our Privacy Policy, which supplements these Terms. By using the Applications or Services, you also agree to the Privacy Policy.

SECTION 4 — ELIGIBILITY AND USER RESPONSIBILITY

You agree to:

use the Applications and Services lawfully, ethically and safely;
provide truthful information when requested, for example in transactions;
maintain the security of your device and any credentials;
comply with these Terms and applicable law.

If you are a minor, use must take place with the knowledge and responsibility of your legal guardian when required by law.

SECTION 5 — LICENSE TO USE

Web Evolui grants you a personal, limited, revocable, non-exclusive and non-transferable license to use the Applications and Services as provided.

Without prior written authorization, you may not:

copy, modify, adapt, translate or create derivative works;
reverse engineer, decompile or attempt to extract source code, except where permitted by law;
circumvent technical, security, access or usage restrictions.

SECTION 6 — CONTENT, FEATURES AND AVAILABILITY

Web Evolui may change, suspend, remove or update features of the Applications and Services at any time, including for technical, security, legal, maintenance or improvement reasons. We do not guarantee continuous availability.

SECTION 7 — PURCHASES, SUBSCRIPTIONS AND REFUNDS (WHERE APPLICABLE)

Some Applications may offer paid features, subscriptions, in-app purchases or premium plans. In these cases, charges may be processed by stores or payment processors, such as Google Play, the App Store or payment gateways, and cancellation and refund rules may follow those services’ policies.

SECTION 8 — THIRD-PARTY SERVICES AND LINKS

The Applications and Services may integrate with, depend on or redirect to third-party services. These third parties have their own terms and policies. Web Evolui is not responsible for third-party practices, unavailability or content.

SECTION 9 — PROHIBITED USE

You agree not to:

use the Applications and Services for illegal, fraudulent or abusive purposes;
interfere with their operation, including malicious traffic, exploitation of vulnerabilities, improper automation or circumvention of limits;
access unauthorized areas or improperly collect data;
infringe the intellectual property rights of Web Evolui or third parties.

SECTION 10 — INTELLECTUAL PROPERTY

The Applications and Services and their elements, including branding, layout, text, code, logos, images and content, are protected by intellectual property rights and belong to Web Evolui or its licensors. Use does not grant ownership rights.

SECTION 11 — DISCLAIMER OF WARRANTIES

The Applications and Services are provided ‘as is’ and ‘as available’. To the fullest extent permitted by law, we do not guarantee fitness for a particular purpose, absolute accuracy, freedom from faults or continuous availability.

SECTION 12 — LIMITATION OF LIABILITY

To the extent permitted by applicable law, Web Evolui will not be liable for indirect damages, lost profits, loss of data, business interruption, failures of third parties, stores, networks or the user’s device, or misuse.

SECTION 13 — INDEMNIFICATION

You agree to indemnify Web Evolui for losses and costs arising from misuse, violation of these Terms or infringement of third-party rights.

SECTION 14 — SUSPENSION AND TERMINATION

We may suspend or terminate your access in the event of a violation of these Terms, a legal requirement, a security risk or suspected fraud or abuse. You may stop using the Applications and Services at any time by uninstalling the app or discontinuing access to the website.

SECTION 15 — CHANGES TO THE TERMS

We may modify these Terms at any time. The updated version takes effect upon publication. Continued use after changes indicates agreement.

SECTION 16 — GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of Brazil. The courts of the user’s place of residence shall have jurisdiction where required by consumer protection rules; otherwise, another competent court may be determined under applicable law.
